1. Scope & Acceptance of the Agreement
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "User", or "You") and HostMods.com ("HostMods", "We", "Us", or "Our").
By creating an account, ordering a game server, downloading digital content, or utilizing any services provided on HostMods.com, you expressly agree to be bound by these Terms, our Privacy Policy, and our Refund & Withdrawal Policy. If you do not agree, you must not use our platform or services.
2. Acceptable Use Policy (AUP)
You agree to use HostMods infrastructure exclusively for lawful purposes. The following activities are strictly prohibited and will result in immediate service suspension or termination without compensation:
- Malicious Network Activities: Launching Denial of Service (DoS/DDoS) attacks, network stress tests, port scanning, or spoofing from our servers.
- Illicit Content & Exploitation: Hosting malware, trojans, ransomware, pirated intellectual property, or abusive content.
- Engine Abuse: Modifying game server binaries to inject malicious client-side exploits, slowhack commands, or unapproved redirect loops designed to harm players' game installations.
- Resource Monopolization: Utilizing server instances for cryptocurrency mining, torrent seeding, or unauthorized proxying outside of permitted game server workloads.
3. Service Provisioning & 99.9% Uptime SLA
HostMods commits to maintaining a 99.9% network uptime SLA on all bare-metal edge nodes.
Game server instances are automatically provisioned upon confirmation of payment. Standard maintenance windows are announced in advance through our platform status channel. Uptime guarantees exclude scheduled maintenance, force majeure events, and outages caused by customer misconfigurations or unsupported third-party plugins.
4. Statutory Right of Withdrawal (EU Directive 2011/83/EU & Consumer Protection)
If you are a consumer residing within the European Union, you generally have a statutory right to withdraw from a distance contract within 14 calendar days from the date of contract conclusion without giving any reason.
Because game servers are automatically installed, configured, and bound to dedicated server resources immediately upon order completion, you are required to make this express request at checkout if you wish to enjoy immediate automated deployment.
If you exercise your right of withdrawal after making such a request, you remain liable to pay an amount proportional to the service provided up to the time you communicated your withdrawal, compared with the full coverage of the contract. Where a service has been fully performed upon your express request and acknowledgment, the right of withdrawal is extinguished.
5. Digital Products, Plugins & Digital Content
For digital content not supplied on a tangible medium (including custom AMXX plugins, mod archives, scripts, and downloadable assets):
In accordance with statutory consumer provisions, when you purchase digital content and expressly request immediate delivery and acknowledge that you thereby lose your right of withdrawal once download or access has commenced, your right of withdrawal is waived upon the start of transmission or download enablement.
6. Mandatory Legal Rights Guarantee (Defective or Non-Conforming Services)
7. Billing, Invoicing & Renewals
All services are billed on a pre-paid basis according to the selected billing cycle (30 Days, 90 Days, 180 Days, or 365 Days). Payment is processed securely via PayPal or other approved payment processors.
Electronic invoices are generated and accessible via the Client Space. Invoices record the customer details, IP address, exact payment method, transaction identifier, and verified statutory consent audit logs.
8. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the European Union. In the event of any inquiry or dispute, customers are encouraged to open a support ticket via our Helpdesk at hostmods.com/tickets. Consumers within the EU may also submit disputes through the European Commission's Online Dispute Resolution (ODR) platform.
