Refund & Statutory Withdrawal Policy

1. Overview & Statutory Consumer Rights

At HostMods.com, we believe in complete transparency and strict adherence to European consumer protection laws, including the European Consumer Rights Directive (Directive 2011/83/EU) and corresponding national enactments (such as the Italian Consumer Code).

We do not operate on an arbitrary "NO REFUNDS" blanket policy. Instead, our refund and cancellation rules clearly distinguish between Game Server Hosting Services and Digital Content / Downloads, ensuring every customer's statutory rights are fully preserved.

2. Game Server Hosting Services

Game server hosting constitutes an ongoing digital service. The statutory rules apply as follows:

• Immediate Service Commencement: Game servers are provisioned automatically within seconds of payment. To allow instant deployment without waiting 14 days, you must make an express request at checkout: "I request HostMods to begin providing the game server hosting service immediately after successful payment, before the expiry of the statutory withdrawal period, and I expressly acknowledge the applicable consequences for my right of withdrawal."
• Withdrawal During Active Hosting: If you exercise your statutory right of withdrawal after the service has begun, you will only be charged a proportional amount corresponding to the exact number of days the service was active up to the date of your notice. The remainder of your payment will be refunded.
• Full Performance: Once a service period has been fully provided under the contract, the right of withdrawal is extinguished.

3. Digital Products & Mod Downloads

For downloadable content, AMXMODX plugins, custom configurations, and mod resources:

• Immediate Delivery Consent: Digital goods are delivered electronically immediately after payment. At checkout, you are asked: "I request immediate delivery/access of the digital content after successful payment and acknowledge that, once delivery/access/download begins, I may lose my statutory right of withdrawal."
• Waiver Upon Access: Once access to the digital file is granted or downloading has commenced following your express consent, the statutory right of withdrawal is lost in accordance with statutory consumer rules.
• Pre-Download Cancellation: If you have purchased a digital product but have not yet accessed or downloaded the files, you may request a 100% full refund within 14 days.

4. Mandatory Legal Guarantee (Defective / Not As Described)

If our hosting service suffers continuous, unresolved downtime not attributable to your configuration, or if a purchased digital mod is proven defective and cannot be resolved by our technical staff within a reasonable period, you are entitled to statutory remedies including repair, replacement, or a proportionate or full refund.

5. Cryptographic Evidence & Dispute Protocol

To protect both consumers and HostMods against fraudulent payment disputes, our automated billing engine permanently logs verifiable audit trails with each transaction:

• Exact timestamp of Terms of Service acceptance
• Exact timestamp of express Immediate Activation request
• Customer IP address and browser User-Agent at time of consent
• Payment processor authorization token and transaction reference
• Automated container initialization and IP:Port binding timestamp
• Download enablement and access log timestamps

These logs provide indisputable, transparent records for PayPal, payment processors, and banking institutions in the event of an inquiry.

6. How to Submit a Withdrawal or Refund Request

To submit a cancellation or refund inquiry:

1. Log into your HostMods Client Space and navigate to Support Tickets.
2. Click Open Support Ticket and select Billing & Refunds.
3. Provide your Order ID, Server ID, and reason for withdrawal.
4. Our senior billing team will review your request and respond within 24 hours. Approved refunds are credited directly back to the original payment method (e.g. PayPal account).
